Is AI virtual staging legal for real estate listings?

AI virtual staging is legal in all 50 U.S. states—but mandatory disclosure is required everywhere. NAR's Code of Ethics Article 12 requires all virtually staged photos to be clearly and conspicuously labeled (e.g., 'Virtually Staged'). Most MLS boards require: a visible watermark on each staged image, disclosure in listing remarks, and original unstaged photos available alongside staged versions. California's AB 723 (effective January 2026) goes further—making non-disclosure of digitally altered listing photos a criminal misdemeanor. Always check your local MLS rules for specific requirements.
